Privacy Policy
Wowza® Media Systems, LLC ( “Wowza”) values your privacy and takes the protection of your privacy seriously. This Privacy Policy (this “Policy”) describes how we collect, use, and disclose personal information that we obtain about visitors to our website www.wowza.com (including all related webpages and sites, the “Site”), users of Wowza software and mobile device applications (collectively, the “Software”), and services provided or resold by Wowza (each, a “Service”).
By visiting the Site or using Software or a Service, you agree that your personal information will be handled as described in this Policy, and consent to the same. Your use of the Site, Software, or a Service, and any controversy or dispute related to the privacy or use of your personal information, is subject to this Policy, along with other applicable terms and conditions, including limitations on damages and resolution of disputes (the applicable End User License Agreement for Wowza Streaming Engine software (“EULA”) or Terms of Use for Wowza Video (“TOU”), as examples), which are incorporated by reference into this Policy. Children’s Data
Wowza does not knowingly collect personal information from any individuals under the age of 18 through our Site, Software, or Services. If you are under 18, please do not provide any information through our Site, Software, or Services. Please let us know if you believe we have collected personal information from someone under the age of 18. If we learn that we collected or received such information without appropriate parent/guardian consent, we will delete that information.
Updates to this Policy
Wowza may update this Policy occasionally to ensure that you are informed of our practices with regard to personal information. When we update this policy, we will update www.wowza.com/legal/privacy and, depending on our view of the significance of the update, send an email to all Site, Software, and Services users for whom we have email addresses notifying them of the update. Your continued use of the Site, Software, or Services following such an update to this Policy on the Site indicates your acceptance of the updated Policy.
Location of Data; International Transfers
Wowza is headquartered in the United States, but we provide services globally. When you use our services from outside of the U.S., your personal information may be transferred to, stored in, and processed in the U.S. Without limiting the foregoing, and as necessary to provide the Site, Software, and Services, Wowza may also process your personal information in other jurisdictions around the world, including China, the European Union (including Germany and Ireland), Japan, South Korea, the United Kingdom, and the U.S. By providing us with your personal information, you consent to such transfer, storage, and processing of your information anywhere in the world. Some jurisdictions may have data-protection laws less stringent than those in your home jurisdiction. As required by applicable law, we will enter into data protection agreements or other legally approved mechanisms to lawfully transfer and otherwise process personal data internationally, such as standard contractual clauses, lawfully approved certifications, compliance with a jurisdiction’s data privacy framework, or binding corporate rules.
What Personal Information Does Wowza Collect About You?
Wowza may collect personal information directly from you and, where allowed by law, from third parties as well as through your use of our Site, Software, and Services. As used in this Policy, “personal information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, device, or household. Personal information falls within certain categories, such as:
- Identifiers (e.g., name, email, telephone number, address, username, social-media handles, IP address, device ID);
- Sensitive Personal Data (e.g., government identification number; precise geolocation; racial or ethnic origin; national origin; citizenship or immigration status; religious beliefs; mental or physical condition or diagnosis; sexual orientation; status as transgender or non-binary; status as a victim of crime; contents of messages when we are not the recipient; in some cases, information about a known child);
- Legally protected information (e.g., race, citizenship, marital status, sex);
- Employment-related information (e.g., current or past employment);
- Non-public educational information, including information protected under the United States federal Family Educational Rights and Privacy Act;
- Biometrics (e.g., DNA, face/voice prints, retinal or iris pattern, gait, health data) and audio, electronic, visual, thermal, or olfactory information;
- Inferences drawn from personal information to create a profile about preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, and aptitudes;
- Commercial information (e.g., products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies); and
- Internet or other similar activity (e.g., browsing history; content interactions).
Information We Collect Directly From You. Certain areas and features of the Site, Software, or Services may require registration or the submission of information by you. When you register for an account we process: (i) your personal details (e.g., your name, e-mail, user name and password); (ii) records of your consents to our processing of your personal data; (iii) payment details (e.g., your billing address); (iv) information about your use of our Sites, Software, and Service (e.g., the type of device you are using); (v) details of your current business sector (B2B); (vi) information about your interactions with our Sites, Software, and Services; and (vii) any views or opinions if you provide them to us.
When you register for a trial or download content we process: (i) your personal details (e.g., your name, e-mail, user name and password); (ii) records of your consents to our processing of your personal data; (iii) details of your current business sector (B2B); (iv) information about your interactions with our Sites, Software, and Services; and (v) any views or opinions if you provide them to us.
Where the submission of information by you is optional, rather than required, we take reasonable measures to make this distinction clear (marking required fields “required,” for example).
Information We Collect Automatically. We may automatically collect information about you and your use of the Site, Software, or Services through cookies, web beacons, and other technologies and methods. The information we collect in this manner may include the following: your domain name, IP address, approximate location, and manner in which you connect with or to the Site, Software, and Services; information about your browser, device, operating system, and mobile device; the date and time on which you visit the Site or use the Software or Services and the length of time you do so; details regarding your use of the Site, Software, and Services, and other software products or services; web pages you view and links you click or access; information related to your payment for Software and Services; and the referring URL, site, or services that led you to the Site and information related to that referral.
Your choice. You may always choose whether to share personal information about yourself with Wowza, but please note that our Site, Software, and Services may each fail to provide you with certain functionality or benefits if you do decline to provide such information.
Personal Information We Have Collected Over the Last 12 Months
During the last 12 months, we have collected the following:
- Identifiers: name, mailing address, email address, telephone number, and payment-card information (through our payment-processing vendor).
- Commercial information: a history of your purchases, including usage of Software and Services.
- Internet or similar activity: IP address and information collected using cookies.
What Do We Do With the Information We Collect?
In general, we use information we collect about you to provide, develop, and improve our Site and the Software and Services, to develop new products and services, to customize and target content and information we provide or market to customers and others, and to comply with laws and court orders. Some examples of our use of the information we collect include the following:
- To provide our Software and Services. For example, to deliver the Software and Services to our customers, we may need to collect and authenticate your personal information as an end user.
- For customer service purposes. For example, to communicate with you about your use of the Site, Software, or Services, to respond to your inquiries, to fulfill your orders, and for other similar purposes.
- To personalize your experiences on the Site and in the Software and Services. For example, to tailor the content and information that we send or display to you, to display targeted advertising, to offer location customization, and to offer personalized help and instructions.
- For marketing and promotional purposes. For example, in accordance with applicable law, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you and your use of our Site, Software, and Services to assist us in advertising on third party websites and for other purposes.
- For product and service improvement purposes. For example, to better understand how users access and use our Site, Software, and Services, both on an aggregated and individualized basis, in order to improve our Site, Software, and Services, to respond to user desires and preferences, and for other research, analytical, and commercial purposes.
- For security purposes. For example, we may block certain IP addresses or users who are associated with fraudulent or malicious activities, or who have previously violated the terms of use governing the Site, Software, or Services.
How We Share Your Information
In general, Wowza does not sell, rent, or share personal information about you to outside third parties other than authorized vendors, service providers, and partners. The use of third-party vendors for analytics and targeted advertising has been interpreted to be a “sale” and “sharing” by some privacy regulators, however. We are therefore disclosing that we may sell or share your personal information to specific categories of third parties, but we do so with the restrictions outlined below. Without limiting the foregoing, Wowza may share the information that we collect about you, including personally identifiable information, as follows:
- Other Wowza Customers and Site Visitors. Your user name, name, and other information that you post to the Site, including, without limitation, reviews, comments, and feedback will be available to, and may be searchable by, other users of the Site, regardless of whether they have signed up or otherwise identified themselves to Wowza. Even if it appears presently that such information about you is not available to others, we may change or improve Site functionality in the future, resulting in such information being available to other Wowza customers and Site visitors.
- Affiliates, Subsidiaries, and Partners. We may disclose the information we collect from you to our affiliates, subsidiaries, and partners (including resellers, for example); however, if we do so, their use and disclosure of your personally identifiable information will be subject to this Policy, and, where required by law, we will obtain your consent to such transfers.
- Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors, or agents who perform functions on our behalf. These include, for example, payment processors and third-party cloud providers, to whom we transfer information about you in order to process payments and data for the Site, Software, and Services. Other examples include providers of third-party cookie (and other analytics and tracking technology) providers; more information regarding these third parties is available in the “Use of Cookies” section below and through our Site’s cookie manager.
- Third-Party Ad Networks. Similarly, we work with third parties, such as network advertisers, to display advertisements on our Site, Services and Software, as well as to display Wowza ads on third-party websites. Network advertisers are third parties that display advertisements based on your use of our Site, Software, and Services, along with other third-party websites and mobile applications usage. This enables both Wowza and these third parties to target advertisements by displaying ads for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors, and/or traffic measurement services may use cookies and and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with information about your usage of our Site, Software, and our Services.
- Business Transfers. If we are a party to a merger, acquisition, or other corporate restructuring (or similar activity), we may transfer the information we have collected to another company party to such activity. Similarly, if we are a party to a bankruptcy proceeding, the information we have collected about you may be transferred to an acquiring or merged entity.
- In Response to Legal Process. We may disclose the information we collect from you in order to comply with applicable law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
- To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, suspected or actual violations of this Policy or other agreements (including acceptable use policies) between you and Wowza or our partners, or as evidence in litigation in which Wowza is involved.
- With Your Consent. There may be circumstances not covered by this Policy where we would like to share certain personal information about you. In those circumstances, we will let you know and obtain your consent.
- Anonymized and Aggregated Information. We may share anonymized and aggregated information about our users with third parties for any purpose without restriction.
Use of Cookies and Other Tracking Mechanisms by Wowza; Global Opt-Out Mechanism
As more fully disclosed through the cookie-manager tool available through our Site, Wowza uses cookies, web beacons, and similar tracking technologies to (i) analyze trends, administer the Site, perform analytics functions such as tracking movements around the Site, and gather demographic information about our audience as a whole and (ii) target and customize advertisements that may be displayed to you on our Site and third-party websites. We may receive reports from these tracking technologies on an individual and aggregated basis.
To learn more about these technologies, how Wowza uses them, and your choices regarding Wowza’s use of these technologies, please review the information available through our cookie-manager tool. You can use our cookie-manager tool to opt out of all cookies our Site uses except cookies necessary for Site functionality.
In addition, our Site responds to Do Not Sell and Do Not Track signals, and a global opt-out mechanism (currently, the Global Privacy Control), all of which you can activate through your browser or device settings. Specifically, you can indicate your desired privacy settings through your browser or device, and our Site will receive those preferences and act accordingly.
User Profiles
Unless prohibited by applicable law or our agreements with Wowza customers, we may combine information gathered from cookies and other tracking mechanisms with other personal information we collect from you in order to be able to provide a more personalized service to you. If you do not agree to such user profiling, you may opt-out by contacting us at privacy@wowza.commailto:. In this case, we will send you instructions on how to opt-out.
Third-Party Sites, Goods, and Services
The Site, Software, and Services may contain links to third-party goods, services, and websites. Any access to and use of such goods, services, or websites is not governed by this Policy, but instead is governed by the terms, policies, and procedures of those third parties. We are not responsible for the practices of such third parties and do not have the ability to control such practices: you assume all risks associated with such third parties.
Retention of personal data
We retain your personal data for the duration of your business relationship with us or, as applicable, where we have an ongoing legitimate business need to do so – such as to provide our Site, Software, or Services, resolve disputes, enforce our rights, or to comply with applicable legal, tax, or accounting requirements. In any event, we hold your information only as long as necessary for each purpose we use it, unless we have obtained your consent to use it for another or similar purpose. When we no longer have a legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, where your personal information has been stored in backup archives), we will securely store your personal information and isolate it from any further processing until it is deleted.
Security of Personal Information
We have implemented commercially reasonable measures to protect the information we collect about you from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Of course, despite any amount of effort, no data security measures can guarantee security or confidentiality, and we encourage you to also take prudent measures to protect your information. Prudent steps include signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password information private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
Your Choices and Rights
We understand you want to protect and control your personal information. We are also committed to complying with applicable laws. This section details how you may review, update, or delete certain personal information and exercise any additional rights you may have under applicable law.
- Opting Out of Text Messages and Promotional Emails. You may opt out of receiving any text messages by replying “STOP.” You may opt out of marketing or promotional emails from Wowza by (1) clicking the “Unsubscribe” (or similar) link in those emails or (2) emailing privacy@wowza.com. Please keep in mind that you may still receive transactional and service-related emails from us, such as emails related to your license and payments.
- Other Rights. In the United States, consumer privacy is governed by federal privacy laws covering specific types of data and/or data uses, and state privacy laws providing general consumer-privacy rights. This section provides additional information regarding state-level privacy laws that are currently, or will soon be, in effect. Residents of such states can exercise their privacy rights by submitting a request to us as indicated in the Contact Us section below. Please note that, in many situations, Wowza is acting in the capacity of a service provider and will be limited in its ability to address your requests – other than to refer you to the applicable Wowza customer. Please also note that the below list may contain rights that are not applicable to you (e.g., if you live in a state without a comprehensive privacy law).
- Right to Correct. You have the right to request that we correct inaccurate personal information about you. If you become aware that the personal information that we hold about you is incorrect, or if your information changes, please inform us and we will update our records.
- Right to Deletion. You have the right to request that we delete your personal information, with certain exceptions.
- Right to Know/Right to Access/Portability. You have the right to request confirmation regarding whether we have collected personal information about you and that we provide you with access to that personal information. If you submit an access request, we will provide you with copies of the requested pieces of personal information in a portable and readily usable format. Please note that we may be prohibited by law from disclosing certain pieces of personal information, and we may be limited in the number or frequency of requests we must fulfill.
- Right to Disclosure. You may request that we disclose information to you about our collection and use of your personal information, such as: (i) the categories of personal information we have collected about you; (ii) the categories of sources for the personal information we have collected about you; (iii) our business purpose for collecting, using, processing, sharing or selling that personal information, as applicable; (iv) the categories of third parties (and in some jurisdictions, the specific third parties ) with whom we share that personal information; and (v) if we sold or shared your personal information for cross-contextual behavioral advertising (as defined by applicable law), two separate lists stating: (A) sales or sharing, identifying the personal information categories that each category of recipient purchased; and (B) disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained. Certain laws limit the number or frequency of requests we must fulfill.
- Limited Use and Disclosure of Sensitive Personal Data. You have the right to opt-out of or limit our use of your sensitive personal information, but please note that Wowza does not require you to provide sensitive personal information. If you choose to provide us with sensitive personal information, we will only use it to provide you with the products and services you request. In no event do we disclose any sensitive personal information for the purpose of inferring characteristics about you. If this ever changes in the future, we will update this Policy and provide you with methods to limit our use and disclosure of your sensitive personal information.
- Opt-Out of Selling and Sharing. You may opt-out of the sale or sharing of personal information for targeted advertising practices by adjusting your cookie and/or browser settings, or by submitting a request by email at privacy@wowza.com. If you submit your request by email, please put “OPT-OUT REQUEST” in the subject line.
- Right to Opt-Out of Profiling. You have the right to opt-out of certain automated profiling, particularly if the profiling is done in connection with access to critical goods or services (e.g., essential goods or services or employment).
- Right to Nondiscrimination. We will not discriminate against you for exercising your privacy rights. For example, unless permitted by law we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services, because you exercised a right under applicable privacy laws.
- Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding personal information sharing with affiliates and/or third parties for marketing purposes.
- Right to Appeal. If, after submitting a request under this section, you believe we have refused to act according to applicable law, you may appeal our action or inaction by using the following appeal process:
- As indicated in the Contact Us section below, send us a notice with “Privacy Rights Appeal Notice” in the subject line (“Appeal Notice”) within 60 days of the earlier of either (i) our rejection of, or failure to fully comply with, your request or (ii) if we have not responded to your request, when you initially submitted your request.
- The Appeal Notice must contain information sufficient for us to verify your state of residence, identity/authority to act on behalf of the consumer, and evaluate your appeal.
- We will either approve or deny your appeal within 45 days of your Appeal Notice, and will notify you in writing (which may be by email), of our decision and the reason(s) for our decision.
- If we deny your appeal, our notice may provide you with contact information for the attorney general in your jurisdiction so you may submit a complaint to them.
Additional Information for International Residents
Residents of certain foreign countries have legal rights that overlap with those set forth in the “Other Rights” section above. They may also have legal rights associated with their personal data (“Personal Data”) beyond the generally applicable rights set forth above. If you are a resident of such a foreign jurisdiction, this section provides you with additional information associated with those rights.
- International Transfers. As disclosed above, Wowza is headquartered in the United States and Personal Data will be transferred to, processed, and maintained on computer systems located in the United States. The United States is not currently a country the European Union has deemed “adequate” under applicable data protection laws. We may enter into data protection agreements or other legally approved mechanisms with our vendors to support compliance with applicable law, however. Specifically, we will take appropriate safeguards to require that Personal Data we process will remain protected in accordance with this Policy when transferred internationally, including when processed by third-party service providers and partners. The safeguards we will take may include one or more of the following: implementing standard contractual clauses, relying on a third-party service provider’s lawfully approved certification and/or compliance with a data privacy framework, or binding corporate rules.
- Wowza as Controller. For Personal Data we collect from our Site, Wowza is the data controller.
- Wowza as Processor. For Personal Data we process in connection with providing our Software or Services on behalf of Wowza customers, Wowza is generally the data processor. We may therefore be limited in our ability to provide certain information and will only refer you to our customer/the data controller.
- Legal Basis for Processing. Wowza collects and uses Personal Data based on our delivery of requested goods or services, legitimate business interest, or consent. More specifically, we will collect Personal Data from you: (i) where we have your consent; (ii) where we need your Personal Data to provide the Site, Software, and/or Services you requested and/or perform a contract with you; (iii) where we have a legal obligation to do so; or (iv) where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms (such as processing for administrative purposes, product development or improvement, preventing fraud or criminal acts, or securing information that we collect). - Onward Transfers. As disclosed above, Wowza engages third-party providers to provide system infrastructure, email, payment processing, and other tools that are necessary for providing our Site, Software, and Services. Such third parties act in accordance with the terms of our agreements, which include appropriate data-protection provisions. These agreements require that these third parties use your Personal Data only in a manner consistent with our instructions and applicable law.
